Lost Lake denied by Public Service Commission

FORESTBURGH — On October 2017, the Lost Lake Resort company filed a request for a waiver from the Public Service Commission's (PSC) regulation 16 NYCRR §100, which requires all electric infrastructure in new developments to be installed underground.

The request was once again denied by the PSC, insisting that Lost Lakes must install its power lines below ground.

“Lost Lake ignored the 2016 order's limited allowance for refiling, and is now seeking an untimely rehearing of the 2016 order as it pertains to Phase I,” said John B. Rhodes, Chair of the PSC. “Presenting substantially identical arguments, which remain insufficient.”

For Phase I of the Lost Lake, the initial plan is to finish the building 400 lots, the front nine holes of the golf course and the water treatment and processing plants that will be constructed along Cold Spring Road. The complex already has a sales office built and almost a mile of paved road.

Additionally, “Granting Lost Lake's petition under these circumstances would be a signal to developers that they may ignore the finality of the Commission's determinations and make untimely requests for the same relief in hopes of a favorable outcome, which would only serve to erode the Commission's authority and waste administrative resources,” said Rhodes.

Back in 2007, Double Diamond, Inc., a Texas-based developer, purchased 2080 acres in Forestburgh with the goal of developing Lost Lake Resorts.

The resort is slated to have up to 2,557 single family residential lots along with condos and multifamily units and looks to be on the most significant developments in the town's history.

According to Forestburgh Town Supervisor Dan Hogue Jr., some residents of Lost Lake Resorts have been offered lots at the Lost Lake sister property in Pennsylvania. Some residents have taken the offer, according to Houge.

“I think a lot of decisions are based on everything that has happened in the last couple of storms with the power being out,” said Hogue Jr.

“I have been going by almost every single day looking for someone, but I haven't seen anyone,” said Hogue Jr. “There are a lot of rumors that it was sold. I don't know; they are all rumors. Lost Lake hasn't returned any calls to me,” added Hogue Jr.

Attempts by the Democrat to reach Double Diamond, Inc. were unsuccessful.

“If they do sell it, it is my understanding that any purchaser is bound to the terms of the PDD as granted. Any deviation from that would require them to come back to the town for permission to change it,” said Hogue Jr.
