Liberty man charged in fatal hit and run

LIBERTY — The Sullivan County Sheriff's Office announced on Monday that they've made an arrest in connection to a fatal hit and run that occurred in Liberty on Saturday night.

Around 9:45 p.m. on Saturday, Sheriff's Deputies were called to 2642 State Route 52, between Frankie Lane and Hanoffee Drive, for reports of a pedestrian struck by a vehicle.

Upon responding to the scene, deputies found Dennis Toscano, 60, deceased on the shoulder of the highway. An investigation revealed that Toscano was unloading groceries from his car when another vehicle, traveling westbound towards White Sulphur Springs, struck him and fled the scene.

By Sunday morning, The Sheriff's Office had issued a press release asking the public to be on the lookout for a 2010 - 2012 dark blue Subaru Legacy with front end damage.

The Sherrif's Office had asked anyone with information on the vehicle or suspect to contact them directly at (845) 794-7100 or through their Confidential Tips Line at (845) 807-0158.

According to Undersheriff Eric Chaboty, they were able to determine the type of vehicle involved in the collision based on broken car parts left behind at the scene. Based on that information, deputies arrested Joseph Maxwell Jr., 34, of Liberty on Sunday night and charged him with leaving the scene of a fatal accident, a Class-D felony.

Maxwell Jr. was arraigned Monday morning in front of Judge Harold Bauman on the alleged charge and was remanded to the Sullivan County Jail in lieu of $50,000 bail.

Maxwell Jr. was due back in court on Tuesday.

Sheriff's deputies were assisted at the scene on Route 52 by the Liberty Fire Department, New York State Police, the Liberty Village Police, District Attorney's Office and State DOT.

Since Saturday night, Toscano has been remembered by friends and family as a kind and generous man of many talents and hobbies. In addition to being a motorcycle enthusiast, Toscano was known as an avid runner and participated in many local marathons.

A GoFundMe page has been established at gofundme.com/f/funeral-for-dennis-toscano to help the family with the costs of services and a memorial. As of presstime yesterday it had raised nearly $4,000

According to the page, Toscano is survived by two children, two step-children, siblings, nieces and nephews and his girlfriend.
