Monticello adopts good cause eviction, clean air laws

MONTICELLO — The Village of Monticello Board of Trustees unanimously adopted two local laws Wednesday, June 3, aimed at tenant protections and air pollution regulation.

The first law establishes local “good cause” eviction protections, joining other New York communities that have adopted similar measures under state authorization. According to the village, the law is intended to reduce unjust evictions and limit sharp rent increases while providing tenants the maximum protection allowed under state law.

Mayor Rochelle Massey said the move was in an effort to safeguard housing for village residents.

“We have to address affordable housing with all the means we can,” Massey said. “Certainly, increasing the stock of housing which our residents can afford is critical, but so is ensuring that those who have long resided here are not priced out of their dwelling units.”

The village said several local residents supported the law, which took effect immediately.

The board also adopted a clean air law in response to concerns about the possibility of a major incinerator being located in or near the village.

The law requires operators of polluting facilities to measure and report emissions in real time. It also limits emissions in a way the village says would require only highly efficient and safe facilities to be built.

Massey said the measure is part of the village’s responsibility to protect public health.

“Protecting public health is our central priority,” Massey said. “This is accomplished not just by operating a strong police department, but by ensuring that our residents are protected from new sources of air pollution.”

Massey said she and the trustees want to require state-of-the-art technology that provides transparency around air pollution releases and keeps emissions at safe levels.
